According to E!, YOU'RE SO VAIN: Dustin Diamond, who played "Screech" on Saved by the Bell, lost an Internet court arbitration over control of www.dustindiamond.com. Current owner Max Goldberg said that Diamond had an inflated sense of the value of his "brand."Well, this is my last update for 9 days! There's a fan of Dustin, who created this site about him and buyed the domain 'www.dustindiamond.com'. Dustin sued him, because he thought it was taking misadvantage of his brand name (Actually, just his name.) But the current owner of the domain said Dustin overestimated the value of this brand name. The court confirmed this, and Dustin lost his case. Personally I really didn't expect this of Dustin. I think you should be happy that people create a site about you and not sue them because they use you're name in the domain name

I wonder what this Max guy will do now...I'm sure he's not much of a fan anymore BTW - I don't get how he says that he's Dustin Diamond all over the page when in fact he's not Dustin...then at the bottom he does tell us that it's he's not affiliate with Dustin...this Max guy is weird.

I think this Max is a wannabee Screech. The site is really bad, but I think every fansite should be allowed. I mean, every fan is one, right?
Btw that 'I'm Dustin' I think that's to attract attention, although he's actually talking about the picture. People think it's an official site and they like it better. They'll e-mail him, thinking it's official, because they didn't read this small note on the bottom. That's what I think.
Anyways, it's a site, below average. If you buy a domain, at least create someting worthfully to put upon it. It's not doing Dustin's reputation any good, but I still think it was right he lost the case, because the reason would be there for every site. (It would be the same, if NBC sued you. You've a good site, and it should be on. As long as they don't use anything illegal aboiut you, the show, or whatever, I think you should appreciate fansites. If you don't want them to publish wrong information about you, just create an official one and everything is solved.
That guestbook is terrible too, those people are really pathetic (You got a dumb reply too on your post. It just doesn't make sense to say something like that, never, absolutely not when someone is right lol)

I think Dustin was probably more upset about the guestbook than the site. That's what I would be upset about...and that's why I think Dustin should have won. People post some pretty bad stuff about Dustin in there (none of it is true). You are right about being able to make a fansite about whatever you want, but keep the upkeep of your guestbooks, etc. You can't publish wrong information.

Yeah, if you see it that way, you're right. That guestbook is terrible and it's kind of a personal attakc on Dustin. I think every webmaster should keep his site 'clean' if he has one. Erika makes sure that it's always cool to be on this forum, but on the sbtb.com forum there was no controll and you saw what happened :S

Goldberg calls his site an "artistic work of art" Please. Get real. It`s a piece of crap. It looks like a 3rd grader put it together. It`s a cruel, mean website and is just plain wrong. Dustin Diamond is awesome and this website should`nt be allowed on the web. Wrong decision in my opinion.

He took misadvantage of Dustin's name. That's why he sued the guy. But the worst part was the way he used that domain, visit www.dustindiamond.com : It's just a terrible site, and when I posted my first reaction, I didn't read the guest book, because that has a lot of really stupid comments

The suit has nothing to do with bad taste or amateur web design. Dustin Diamond sued over the rights to his name, since it is his name as the domain. Yes, it's true: the site design utterly sucks and reeks of amateur workmanship, but the point is the domain name may cause confusion among Dustin Diamond fans who might mistake the owner of the web site as the real Dustin Diamond (although there is a disclaimer, but that's not the point). It's the same rationale behind Microsoft suing a guy named Mike Rowe who registered the website mikerowesoft.com. It's a simple copyright suit over the rights to Dustin Diamond's name. Simply put, since his name is not an official government trademark, he lost the case. The guestbook has nothing to do with it. It's just a fansite who's domain shares the same name. Now, if Dustin Diamond chooses to sue over character misrepresentation, well, that's another story. <hint hint>
